1. Agreement to These Terms

By accessing or using the Site, you agree to these Terms of Use and our Privacy Policy. If you do not agree, please do not use the Site.

You must be at least 18 years old, or the age of legal majority where you live, to make a reservation or enter into a binding transaction through the Site.

2. Permission to Use the Website

We grant you a limited, revocable, non-exclusive and non-transferable right to access the Site for personal, lawful and noncommercial purposes, including researching the hotel, contacting us and making a reservation.

This permission does not transfer ownership of any Site content or technology to you and may be withdrawn when these Terms are violated.

3. Reservations, Rates and Payments

When you make a reservation, you agree to provide accurate, current and complete information. A reservation is not confirmed until the booking system or Hotel VOS issues a confirmation.

• Rates may change according to dates, suite type, occupancy, availability, taxes, fees, promotions and included services.
• Unless expressly stated otherwise, an advertised rate does not guarantee availability and may be subject to restrictions.
• Payment, deposit, cancellation, modification, refund, no-show and check-in requirements are the terms displayed during booking and included in your confirmation.
• Promotional offers may have separate eligibility dates, exclusions, minimum stays or other conditions.
• You are responsible for reviewing the guest names, dates, suite, occupancy, rate and policies before completing a reservation.

Our booking engine and payment processing may be provided by third parties. Their applicable terms and privacy practices may also govern your transaction.

4. Website Information and Availability

We work to keep descriptions, photographs, amenities, maps, rates and availability accurate. However, information may change and occasional typographical, photographic, technical or pricing errors may occur.

Images are illustrative of the property or accommodation category and may not show the exact view, furnishings, configuration, weather or conditions available during every stay. To the extent permitted by law, we may correct errors and update or withdraw Site content without prior notice.

5. Acceptable Use

You may not:

• use the Site for unlawful, fraudulent or harmful activity;
• attempt to gain unauthorized access to the Site, its servers, accounts or connected systems;
• introduce malware, automated attacks or code intended to disrupt the Site;
• scrape, harvest, copy or commercially exploit Site content without written permission;
• impersonate another person or provide false information;
• interfere with security features or place an unreasonable burden on the Site; or
• use Site content to build or promote a substantially similar or competing service.

6. Intellectual Property

The Site and its text, photographs, video, graphics, logos, branding, design, software and other content are owned by Hotel VOS, licensed to us or used with permission and are protected by applicable intellectual-property laws.

You may view and print reasonable portions for personal travel planning. You may not reproduce, republish, distribute, modify, sell, license, publicly display or create derivative works from Site content without prior written permission, except where applicable law expressly permits.

7. Third-Party Websites and Services

The Site may link to reservation providers, payment processors, restaurants, tour operators, transportation providers, maps, social networks and other independent services. These links are provided for convenience.

We do not control third-party websites and are not responsible for their content, availability, security, privacy practices or independent products and services. Your interactions with a third party are governed by that party’s terms and policies. A link does not necessarily constitute endorsement.

8. Reviews, Messages and Other Submissions

If you submit a review, image, message, comment, testimonial or other content through the Site, you confirm that you have the right to provide it and that it is accurate, lawful and does not infringe another person’s rights.

Unless a separate agreement states otherwise, you grant us a non-exclusive, worldwide, royalty-free right to use, reproduce, format and display submitted content for operating, improving and promoting Hotel VOS. We may decline or remove content that violates these Terms. Personal information remains subject to our Privacy Policy.

9. Disclaimers

To the maximum extent permitted by applicable law, the Site is provided on an “as is” and “as available” basis. We do not guarantee that the Site will always be uninterrupted, error-free, secure or free of harmful components, or that all information will remain current at every moment.

Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded, including applicable consumer protections.

10. Limitation of Liability

To the maximum extent permitted by law, Hotel VOS and its owners, employees, representatives and suppliers will not be liable for indirect, incidental, special, exemplary, punitive or consequential loss arising from use of, or inability to use, the Site or linked third-party services.

These limitations do not apply where liability cannot lawfully be limited or excluded. Reservation and hotel-service liabilities may also be governed by the specific terms supplied with your booking and applicable Costa Rican law.

11. Indemnification

To the extent permitted by law, you agree to indemnify and hold Hotel VOS harmless from third-party claims, damages, liabilities and reasonable expenses resulting from your unlawful misuse of the Site, violation of these Terms or infringement of another party’s rights.

12. Suspension or Termination

We may restrict, suspend or terminate access to the Site when reasonably necessary to protect the Site, our guests, other users, third parties or our legal rights, including when these Terms are violated. Provisions that by their nature should survive termination will remain effective.

13. Governing Law

These Terms and your use of the Site are governed by the laws of the Republic of Costa Rica, without regard to conflict-of-law principles, except where mandatory consumer law provides otherwise.

Any dispute that cannot be resolved informally will be submitted to the competent courts of Costa Rica, subject to any rights or forum that cannot lawfully be waived.

14. Changes to These Terms

We may update these Terms to reflect changes to the Site, our services, technology or legal obligations. The revised version will be posted on this page with a new “Last updated” date. Material changes will apply prospectively unless applicable law requires otherwise.

Your continued use of the Site after revised Terms become effective constitutes acceptance of the revised Terms.

15. General Terms

These Terms, the Privacy Policy and any terms supplied with a reservation constitute the applicable agreement regarding your Site use and booking. If a provision is found invalid or unenforceable, it will be limited or modified only as necessary, and the remaining provisions will continue in effect.

Our failure to enforce a provision is not a waiver. You may not assign your rights under these Terms without our written consent. Section headings are for convenience and do not affect interpretation.
